Sabah controls its own immigration. A federal pass alone does not let anyone work here.
This is the single most common planning error on a first Sabah project. Every pass runs through the Sabah State Immigration Department, and the employer, not the employee, files it. Start the labour licence before you start recruiting, because nothing else in this sequence can move until it exists.
THE ROUTE TO A WORK PASS
Four stages, in this order. The first belongs to your company; the rest attach to each individual hire.
- 01Employer labour licence
Your company must hold a valid licence to employ non-resident workers from the Sabah Department of Labour before it can sponsor anyone. Nothing downstream can be filed without it.
- 02Immigration application
The employer submits the Work Pass or Temporary Employment Pass (PLKS) application directly to the Sabah State Immigration Department, not to Putrajaya.
- 03Supporting documents
A passport with at least six months’ validity, the signed employment contract, academic certificates, and the required security and health bonds.
- 04Medical screening
Foreign employees must complete a medical examination through FOMEMA within 30 days of arrival before the pass is finalised.
WHAT TO HAVE READY
Incomplete files, not immigration policy, are what stretch a four-week pass into a ten-week one. Collect all five before the first submission.
At least six months’ validity remaining at the date of application.
Signed, stating role, salary and term, matching the pass category applied for.
Qualifications relevant to the role, for skilled and professional categories.
Lodged by the employer, at the rate set for the employee’s nationality.
Required alongside the security bond before the pass is issued.
WHAT’S DIFFERENT IN SABAH
Sabah retained control of immigration and labour at the formation of the Federation. Three consequences follow, and all three catch new entrants out.
Sabah controls its own immigration. An Employment Pass issued for Peninsular Malaysia does not admit or permit work here; the pass has to be approved by Sabah Immigration, and the application is lodged in Kota Kinabalu rather than Putrajaya.
Malaysians from Peninsular Malaysia or Sarawak moving to work in Sabah must obtain a work endorsement or exemption stamp under Section 66 of the Immigration Act at the Sabah Immigration office. Apply before you start work, the endorsement is checked on entry and by employers at onboarding.
Sabah has its own Labour Ordinance and its own employer licensing for non-resident workers, processed through the eNORES platform. Run this in parallel with incorporation rather than after it, because it gates every pass that follows.
